Unofficial Notes of 5/6/09 NYS Board of Real Estate Appraisal Mtg.

A copy of the Official Agenda of the May 6, 2009 Board Meeting can be found on our Chapter web page. The following are a few unofficial notes taken by me while attending that meeting between 10:30 am and 12 pm:

1. The meeting was conducted as a webcast between offices of the Department of State in Albany and New York City. There was a quorum and D. Rex Bryce, Vice Chair called the meeting to order.

2. All members in attendance where introduced as well as staff of the Department of State, and public observers.

3. The October 15, 2008 and the February 26, 2009 meeting summaries were approved.

4. A. Mr. Ernest Delany of Enforcement noted that between February 2009 and April 2009, there were 27 new cases for review. At present time, there are a total of 39 open cases.

B. The NYS Appraisal Board Newsletter is in need of articles. If you have an interest in writing and article, you can send it to me at WmHafner@Hafval.com.

C. At present, only continuing education can be taken online. The Board is considering recommending a statutory change to the Legislature to allow qualifying courses online. It was noted that it is more difficult to locate qualifying courses around the state and online education should be considered. However, it will require the Legislature to approve the same.

5. The Board meeting is open and there is a public comment period. Please consider sending your comments to me or attending the next meeting. This is your opportunity to be heard.

6. A. New York State has reciprocity with 22 states and they are listed on the DOS web page. Four additional states (Arizona, Idaho, State of Washington, and South Dakota) were recently added or in the process of being added bring the total to 26 reciprocal states.

B. The legal opinion by the DOS interprets USPAP to suggest that review appraisers can refer a complaint without violating client confidentiality . Please refer to USPAP Advisory Opinions that support the same.

7. Under new business, the Board is investigating the problem with non-conforming uses. FNMA will not accept loans if the property is a non-conforming use and the property can’t be re-built in the event of a loss. This will have a negative impact on most areas of the state.

8. The next meeting of the Board is scheduled for September 18, 2009 at 10:30 am in Albany and New York City.
